In 2024, the City of Bayswater sought feedback from the public regarding the review of the City's Dog Local Law 2016. At the Ordinary Council Meeting (OCM) on 24 September 2024, Council determined to amend the City's Dog Local Law 2016. (See item 10.1.5 of the OCM meeting minutes).
A draft Dogs Amendment Local Law 2025was subsequently developed and presented to Council at the OCM on 29 April 2025, where it resolved to advertise the documentfor public comment. (See item 10.1.3 of the OCM meeting minutes). The public is now invited to have its say on the proposed changes.
What changes are being proposed?
The draft Dogs Amendment Local Law 2025 proposes the following changes:
Removing Part 2 relating to the impounding of dogs: The impounding of dogs is included within the Dog Act 1976and does not form part of most other local government dogs’ local laws.
Inserting a new clause: 2.3 Direction to provide a suitable enclosure: This is in keeping with other local governments dogs’ local laws. The purpose is to for the protection and safety of both the dog and the dog owner.
Changes to Schedule 3 “Offences in respect of which a modified penalty applies”
Increasing the modified penalty for clause 3.9 “Failing to comply with the conditions of a licence” from $200 to $250.
Increasing the modified penalty for clause 4.1(2) “Dogs excreting in prohibited place” from $100 to $150.
Introducing a modified penalty of $200 for clause 2.1 ““Failing to provide effective means to contain a dog.”
Removing the reference to the penalty related to a “dangerous dog” as this is included within the Dog Act 1976 and is no longer required.
