Part 2 - The Impounding of Dogs

The draft proposes removing Part 2 - The Impounding of Dogs because:

  • The Impounding of Dogs is included in the Dog Act, 1976,
  • Is not included in most other local government's Dog Local Laws 

Inserting a new clause: 2.3 "Direction to provide a suitable enclosure"

Inserting a new clause "Direction to provide a suitable enclosure"   is in keeping with other local governments dogs’ local laws. The purpose is to for the protection and safety of both the dog and the dog owner.

Increases to modified penalties included in Schedule 3 "Offences in respect of which a modified penalty applies"

 The draft Dog Local Law Amendment 2025 proposes the following changes to  penalties outline in Schedule 3:

  • Increasing the modified penalty for clause 3.9 “Failing to comply with the conditions of a licence” from $200 to $250.
  • Increasing the modified penalty for clause 4.1(2) “Dogs excreting in prohibited place” from $100 to $150.


Introduction of a new modified penalty to Schedule 3 for  clause 2.1 “Failing to provide effective means to contain a dog”

Clause 2.1 is an existing clause in the current law but does not attract a modified penalty.  The proposed changes include the introduction of a modified penalty of $200 for "Failing to provide effective means to contain a dog."

Removal of the modified penalty related to a "dangerous dog" in Schedule 3

The existing law includes a modified penalty for dangerous dogs in Schedule 3.  The proposed local law removes the reference to the modified penalty for "dangerous dogs" as this is included within the Dog Act 1976 and is no longer required.
