The owner of the above property is seeking approval for a single storey grouped dwelling and single storey grouped dwelling with a terrace at the subject property. In accordance with provisions of the City of Bayswater’s Town Planning Scheme No. 24, the proposal is being advertised for public comment on or before 4:30pm, Thursday 27 April 2017.

The proposed development involves the following variations to the
deemed-to-comply standards of the R-Codes, and your comments regarding these aspects are invited:

  1. In accordance with Clause 5.1.3 'Lot Boundary Setbacks' C3.1, development is to comply with the lot boundary setbacks outlined within Tables 2a and 2b of the R-Codes. Currently the proposal comprises the following lot boundary setback variations:
  • The proposed northern portion of wall (Balance) Unit 1 has a side setback of 1.009 m in lieu of 1.5m.
  • The proposed western portion of wall (balance) Unit 2 has a side setback of 1.514m in lieu of 1.7 metres.

  1. In accordance with Clause 5.4.1 'Visual Privacy" of the R-Codes, a cone of vision setback of 4.5 metres is required. Currently the proposal comprises the following variations:
  • The proposed alfresco Unit 1 floor level is raised greater than 0.5 metres above natural ground level and has a cone of vision setback of 4.5m in lieu of 7.5m to the north.
  • The proposed upper terrace floor level Unit 1 has a cone of vision setback of 6.2m in lieu of 7.5m to the north.
  1. In accordance with Clause 5.3.8 'Retaining Walls', C8.1, development is required to comply with the required setback requirements. Currently the proposal comprises the following variations:
  • The proposed setback of the retaining wall along the northern boundary is nil in lieu of 1.5 metres.

Proposed Change of operation to residential building

Lot 155, 15 Cardwell Avenue, NORANDA

The owner of the above property is seeking approval for change of operation to residential building at the subject property. In accordance with provisions of the City of Bayswater’s Town Planning Scheme No. 24 and the Metropolitan Region Scheme, the proposal is being advertised for public comment on or before 4:30pm, Friday 28 April 2017.

  • A residential building is an 'A' use under the City's Town Planning Scheme No. 24 which means that the use is not permitted unless the local government has exercised its discretion by granting planning approval after giving special notice in accordance with Schedule 2, Clause 64 of the Planning and Development (Local Planning Schemes) Regulations 2015.
  • The residential building is proposed to accommodate up to four children (aged 0-12 years old) on a short-term basis for up to six months and will be staffed by live-in foster carers. Previously the residential building was providing accommodation for up to four children (aged 10-17) for up to two years.
