The proposed development involves the following variations to the deemed-to-comply standards of the R-Codes, and your comments regarding these aspects are invited:

  1. In accordance with Clause 5.1.3 'Lot Boundary Setbacks' C3.1, development is to comply with the lot boundary setbacks outlined within Tables 2a and 2b of the R-Codes. Currently the proposal comprises the following lot boundary setback variation:

· The upper south-eastern portion of wall (balance) is setback 1.2m- 1.5m in lieu of 2.2m.

  1. In accordance with Clause 5.1.3 'Lot Boundary Setbacks' C3.2, development is required to comply with the boundary wall requirements. Currently the proposal comprises the following boundary wall variations:

· The proposed southern boundary wall has a height of 4.1m (maximum) and 3.9m (average) in lieu of 3.5m (maximum) and 3.0m (average).

· The proposed south-east boundary wall has a height of 3.7m (maximum) and 3.4m (average) in lieu of 3.5m (maximum) and 3.0m (average).

  1. In accordance with Clause 5.1.6 'Building Height' C6 of the R-Codes, a maximum top of external wall height of 6m above the natural ground level applies to buildings with a roof above. Currently the proposal comprises the following variation:

· The proposed maximum external wall height is 6.6m in lieu of 6.0m.

  1. In accordance with Clause 5.4.1 'Visual Privacy" of the R-Codes, a cone of vision setback of 4.5m for bedrooms and 6.0m for sitting rooms is required. Currently the proposal comprises the following variation:

· The proposed upper bedroom 2 has a cone of vision privacy setback of 4.4m to the north in lieu of 4.5m.

· The proposed upper sitting room has a cone of vision privacy setback of 4.4m to the south and south-west in lieu of 6.0m.

DEVELOPMENT ASSESSMENT PANEL (DAP) APPLICATION

The owner of the above property is seeking approval for a child day care centre at the subject property. In accordance with provisions of the City of Bayswater’s Town Planning Scheme 24, the proposal is being advertised for public comment. In terms of TPS 24 the property is zoned ' Residential' with a density code of R30.

The proposed development involves the following, and your comments regarding these aspects are invited on or before 4:30pm, Wednesday 27 September 2017:

  • A 'Child Day Care Centre' is listed as a 'D' (Discretionary) use within the Residential zone under Town Planning Scheme 24.
  • The operating hours for the child day care centre is for 5 days per week between 7:15am and 6:30pm, Monday to Friday.
  • The child day care centre is proposed to accommodate a maximum of 92 children and sixteen (16) staff at any one time.
  • The application is proposing 27 car parking bays in lieu of 35 required under TPS 24.
