Short-Term Rental Accommodation - Town Planning Scheme 24 Amendment 101

Background

The State Government has implemented reforms for short-term rental accommodation. This includes a register for all short-term rental accommodation (STRA), and clarification of the circumstances where short-term rental accommodation requires Council approval. The State Government has instructed all local governments to update their Town Planning Schemes to reflect the reforms. The City of Bayswater Council resolved to amend its Town Planning Scheme at the Ordinary Council Meeting held 28 January 2025. The intention of the amendment is to update the scheme text to introduce new land use classes for hosted and un-hosted STRA to facilitate these changes. This is consistent with the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2 – deemed provisions for local planning schemes.

What amendments are proposed

The existing TPS 24 does not make reference to the new STRA land uses, which results in a complex application process and onerous advertising requirements. The change proposes to make provision for STRA land uses in the TPS , which will simplify the application process.

The scheme amendment was advertised from 22 May 2025 to Friday 4 July 2025. A copy of the scheme amendment documents can be downloaded here. The minutes of the Ordinary Council Meeting are also available here. The documents were also available at the City of Bayswater Civic Centre and City of Bayswater libraries.

There were 199 visits to the Engage Bayswater page, with 68 document downloads. 10 submissions were received via the online survey, with 4 in support, 3 in objection and 3 neither in support nor objecting.

Next Steps

Now that the community engagement has concluded the Council will consider all submissions and make a determination whether to proceed with the scheme amendment as advertised, or whether the scheme amendment needs to be modified. The scheme amendment will then be referred to the Western Australian Planning Commission and Minister for Planning for final approval.
