The owner of Lot 15, 45 Ninth Avenue, Maylands is seeking planning approval for a four-storey development comprising 14 multiple dwellings.

The abovementioned property is situated in 'Special Control Area 3 - Town Centre Extension'' of the 'Maylands Activity Centre Zone'. Town Planning Scheme No. 24 outlines the broad development and land use requirements for the area. Special Control Area 3 (SCA3) also outlines a vision for each precinct and provides detailed development requirements such as minimum and maximum building heights, land use, setbacks, solar access and other development standards.

As part of the proposed development, the applicant is seeking variations to the development requirements of SCA3 as follows:

· The 3rd-4th storeys of the building do not meet the side boundary setback requirements. The SCA3 development requirements allow the first two (2) storeys to abut an adjoining boundary whilst levels 3 and above are to be setback a minimum of 5m from the second storey building line. The proposal includes side setbacks of between 1.5m to 2.63m to the north-western elevation and 0.5m to 1.5m to the south-eastern elevation.

· The application proposes 42.86% of dwellings as one-bedroom dwellings. The SCA3 guidelines require a maximum of 30% of all dwellings to be one-bedroom dwellings (4 dwellings). In effect, the proposal provides 6 one-bedroom dwellings in lieu of the permitted maximum of 4 one-bedroom dwellings.

· The application proposes 57.14% of dwellings as two-bedroom dwellings. The SCA3 guidelines require a minimum of 70% of all dwellings to be two-bedroom dwellings. In effect, the proposal provides 8 two-bedroom dwellings, in lieu of a minimum requirement of 10 two-bedroom dwellings.

In accordance with the provisions of the City of Bayswater's Town Planning Scheme No. 23 the application can be inspected between 8:30am and 4.30pm, Monday to Friday up to and including Monday 4 July 2016.
